  • What is a redundancy?

    Redundancy arises under three circumstances – when there has been, or is going to be, either:


    • the closure of the business
    • the closure of the workplace
    • a reduction in the need for employees
  • Is there a legal limit as to how many employees i can make redundant?

    No, you can make as many employees redundant as needed. 


    However if you make over 20 employees redundant within a 90 day period you need to give notify the government


  • Can i make an employee redundant ?

    No, you cannot not make an employee redundant it is the role you are making redundant not the employee. 

  • Do i need to enter into consultation with affected employees?

    Yes, you need to enter into consultation with affected employees. 


    Dependant on the number of employees this will be on a one to one basis or with elected employee / trade union representatives.  

  • What are the minimum consultation periods for making employees redundant?

    The minimum periods for notification and consultation are:


    • less than 20 employees at one location, no set consultation period 
    • between 20 to 99 redundancies at one location, the minimum period is 30 days before the first dismissal
    • 100 or more redundancies at one location, the minimum period is 45 days before the first dismissal
  • What notice do i need to give the government when making more than 20 employees redundant?

    You must notify the government at least 30 or 45 days (depending on the number of dismissals) before the first dismissal and before you issue any individual notices of dismissal.

  • What should I do if faced with having to restructure or make redundancies?
