When entering into any formal process whether it be grievance, disciplinary, absence or performance management, it is important to be able to demonstrate that you have been impartial and kept each stage of the process separate.
Any persons involved in the investigation stage should not be involved in any of the following stages as this will deem to have compromised the process and be unfair to the employee.
This is not always possible in anything other than a large organisation as you may simply not have the manpower or technical knowledge to keep this separation.
One way to maintain separation and impartiality is to have any investigations undertaken by a 3rd party.
You can then use the information and reports provided from the 3rd party to move to the next stage of action if required.
